Terms of Service

These Terms of Service ("Terms") govern your use of the SkuPing application and website operated by SkuPing ("we," "our," "us"). By installing or using SkuPing, you agree to these Terms.

1. Service Description

SkuPing is a BigCommerce application that provides back-in-stock email notification functionality for online stores. The service includes a storefront widget for email capture, automated notification emails, and a merchant dashboard for configuration and analytics.

2. Account and Access

You access SkuPing by installing it from the BigCommerce App Marketplace. Your BigCommerce account serves as your SkuPing account. You are responsible for maintaining the security of your BigCommerce account credentials.

3. Acceptable Use

You agree not to use SkuPing to send unsolicited emails, collect email addresses for purposes other than back-in-stock notifications, or violate any applicable laws including anti-spam regulations such as CAN-SPAM and GDPR.

You agree not to attempt to circumvent usage limits, reverse-engineer the service, or interfere with other merchants' use of SkuPing.

4. Pricing and Billing

SkuPing offers a free tier and paid subscription tiers. Paid subscriptions are billed through BigCommerce's built-in billing system. Pricing is subject to change with 30 days' notice. Usage limits for each tier are described on our pricing page.

5. Data and Privacy

Our collection and use of data is governed by our Privacy Policy. You are responsible for ensuring that your use of SkuPing complies with your own privacy policy and applicable data protection laws.

You acknowledge that subscriber email addresses collected through the SkuPing widget on your storefront are shared with us for the purpose of delivering back-in-stock notifications.

6. Email Delivery

Notification emails are sent from notifications@skuping.com (or a custom domain on applicable plans). We make reasonable efforts to deliver emails promptly but do not guarantee delivery rates, delivery times, or inbox placement. Email delivery depends on third-party services and recipient email providers.

7. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or third-party service disruptions may temporarily affect availability. Support is available via email at support@skuping.com.

8. Intellectual Property

SkuPing and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. The SkuPing name, logo, and branding are our trademarks.

9. Termination

You may stop using SkuPing at any time by uninstalling the app from your BigCommerce store. Upon uninstallation, the widget is removed from your storefront, webhooks are deregistered, and your data is retained for 30 days before permanent deletion.

We reserve the right to suspend or terminate your access to SkuPing if you violate these Terms, with or without notice.

10. Limitation of Liability

SkuPing is provided "as is" and "as available" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost sales, arising from your use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. Continued use of SkuPing after changes constitutes acceptance. Material changes will be communicated via the dashboard or email.

12. Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law provisions.
